Who these terms are with

These terms are an agreement between you and Olivo Group LLC ("Olivo Group", "we", "us"). Olivo Group operates My Loyalty+™, including the website at myloyaltyplus.com, the QR codes and short links that open the service, the pages where you enter your details and see your vouchers, and the messages we send (together, the "Service").

By using the Service, scanning a code, ticking the box that accepts these terms or claiming a voucher, you agree to these terms and to the Privacy Policy. If you do not agree, do not use the Service. Businesses that use My Loyalty+ also sign a separate agreement with us. That agreement does not change your rights under these terms.

What My Loyalty+ is

My Loyalty+ is a free system that lets participating businesses (each a "Business") offer promotions, discounts and vouchers to their customers. You scan a QR code, enter your contact detail (a WhatsApp number, email address or mobile number), your name and your date of birth, accept these terms and confirm it is you with a one-time code or a claim link. You then receive a voucher that you can show at the Business and see in your wallet.

My Loyalty+ is one profile across many Businesses, not a program of a single brand. Participating Businesses may offer promotions through the network, and if you agree to receive offers from My Loyalty+, you may see promotions from Businesses other than the one where you signed up.

Olivo Group does not sell the products or services in a promotion. It provides the system through which a Business shares and validates its offers.

Eligibility and your profile

Vouchers and offers

The offer belongs to the Business

Each offer, discount, voucher and promotion is made by the Business that publishes it. The Business decides its value, availability, validity period, limits, eligible products and locations, and what its staff accept at the counter. The rules shown with an offer are part of these terms for that offer. If they conflict with these terms about the offer itself, the offer's rules apply.

Types of vouchers

Vouchers differ by promotion. Depending on the Business:

Read the voucher to see which type you have, how many times you can use it and until when.

Availability and limits

Offers may have limited quantities, budgets, pacing limits and limits per person. An offer can run out or end before you claim or use it. A voucher counts as issued to you when it is granted to you, not when you use it. We and the Business may apply limits such as one active voucher per person.

Using a voucher

How a voucher is validated depends on the Business. Staff may look at it on your phone and note your name or code, scan its QR code, or check it in a business console. For some products, such as those bought at a supermarket, use cannot be checked directly. In that case a voucher may include a one-tap "I used this" link, and the voucher shows as used when you or the Business confirm it. Use the link only for a voucher you actually used. Anyone who has the link can mark that voucher as used, so do not forward it. A Business may refuse a voucher that is expired, already used, altered, not valid for the product or place, or that looks fraudulent.

No cash value

Vouchers have no cash value, are not payment instruments, and cannot be sold or transferred unless the offer says so.

Promotions with prizes or chance

Some promotions may involve prizes or an element of chance. Each one has its own rules, which show who can take part, the dates, the prizes, how winners are chosen and who runs the promotion.

Regulated products

If a promotion concerns a regulated product, such as a medicine, alcohol or tobacco, the Business is responsible for following the rules that apply to promoting and selling it. A voucher is not medical, legal or financial advice and does not mean a product is suitable for you.

Messages

When you request a voucher, we send you service messages, such as a one-time code, a claim link and your voucher, through the channel you chose (WhatsApp, SMS or email). If you agree to receive offers from My Loyalty+, we also send offers through those channels. Offers may include promotions from participating Businesses.

Your data

The Privacy Policy explains how we collect and use personal data. In short, we keep one profile for you across participating Businesses, we confirm your age and identity, we may ask optional interest questions, and where you agree we may send offers and tailor them to your interests. Participating Businesses see the information described in the Privacy Policy.

Acceptable use

You agree not to:

We may monitor for abuse, apply limits, cancel vouchers obtained improperly and suspend access. Where the law allows, we may share relevant information with the Business concerned and with authorities.

After you claim a voucher, the Service may send you to a Business's website, menu, social page, WhatsApp chat or order page. Those places belong to the Business or a third party. Their terms and privacy practices apply there, and we are not responsible for them.

The website

The website at myloyaltyplus.com describes My Loyalty+ for businesses and lets them send an enquiry through a contact form. The following applies in addition to the rest of these terms.

Intellectual property

My Loyalty+, the My Loyalty+ logos, the name, the designs, and the Service software and content are owned by Olivo Group LLC or its licensors. Business names, logos and offers belong to each Business. We give you a limited, personal, non-exclusive and revocable permission to use the Service for its intended purpose. You may not copy, modify, distribute, sell, reverse engineer or exploit the Service, or use our marks, without written permission.

If you send us feedback, you allow us to use it without obligation to you.

No guarantee

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted, secure or error-free. We do not promise that an offer will be available, that a Business will honor a voucher, or that the Service will work with your device, carrier or messaging app. We are not responsible for the quality, safety or legality of a Business's products or services, or for a Business's decision to accept or refuse a voucher.

Nothing in these terms limits rights you have under consumer protection law that cannot be waived.

Limitation of liability

To the fullest extent the law allows, Olivo Group, its members, officers, employees and providers are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, goodwill or opportunity arising from the Service or these terms. Our total liability for any claim relating to the Service is limited to one hundred US dollars (USD 100). Some places do not allow these limits, so they may not apply to you. Nothing in these terms limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or anything else the law does not allow to be limited.

Suspension and termination

You can stop using the Service at any time and ask us to delete your profile, as the Privacy Policy explains. We may suspend or end your access at any time, including for breach, abuse or legal reasons, or if we end the Service or a promotion ends. Vouchers may be cancelled when a profile is closed for fraud. Sections that by their nature continue after termination, such as intellectual property, disclaimers, liability and governing law, do continue.

Governing law and disputes

These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Courts located in the State of Georgia have jurisdiction over disputes about these terms, subject to the next sentence. If you are a consumer, you keep the mandatory protections and any right to bring a claim in your home courts that the law of your country gives you. Before filing a claim, write to [email protected] and try to resolve the matter informally.

Changes

We may change these terms, the Service or any offer. We post the new terms with a new effective date and, for material changes, tell you through the Service or your contact channel. If you keep using the Service after the effective date, you accept the changes, except where the law requires your fresh consent. A change to an offer does not affect a voucher already issued, except as the offer's own rules say.
